1. Parties

These Terms of Service (the “Agreement”) are entered into between Noma Teknoloji ve Bilişim Hizmetleri Ltd. Şti. (the “Company”, “SetZone”) on the one part and the natural person who registers for or uses the Platform (the “User”) on the other.

2. Definitions

Platform: the SetZone services provided via the setzone.app domain and mobile apps.
User: a natural person aged 18 or older who registers for or uses the Platform.
Service: league/tournament organization, pairing, score tracking, standings, live streaming and all related features.
Match: tennis matches, leagues and tournaments organized via the Platform.
Content: any data, imagery, broadcast and material on the Platform.

3. Subject and Scope

The Agreement governs the terms of the User’s use of the Platform and the parties’ rights and obligations. By registering and by using the Platform, the User declares that they have read and accepted this Agreement and the referenced Privacy Policy, Data Protection (KVKK) Policy and Data Processing Notice.

4. Membership and Account

Only individuals aged 18 or older may register. The User represents and warrants that they are over 18.
The User accepts that the information provided upon registration is accurate, current and complete.
Account security and password confidentiality are the User’s responsibility; the User is responsible for all activity performed through the account.
The Company reserves the right to suspend or close accounts that provide false information or breach the Agreement.

5. Nature of the Service

Unless otherwise stated, the Service is provided free of charge. The Service is provided “as is” and “as available”; the Company does not warrant that it will be uninterrupted or error-free. The Company reserves the right to modify, suspend or terminate the scope, content and features of the Service, with or without prior notice.

6. User Obligations

Use the Platform in accordance with the law, morality and this Agreement.
Report scores and match results accurately and honestly; observe fair-play principles.
Not infringe other users’ rights; refrain from insult, harassment, threats or discrimination.
Refrain from actions that jeopardize Platform security, manipulate the system or achieve unauthorized access.
Warrant that the content they share does not infringe third-party rights.

7. Live Streaming, Image and Audio Recording — Explicit Consent, Assent and Waiver

The User separately and expressly accepts the following provisions:

The User acknowledges and, freely and in advance, expressly accepts that the leagues, tournaments and matches organized within SetZone may be recorded with image and audio via court-side cameras and microphones, and may be broadcast live over the internet publicly (including on third-party platforms such as YouTube).
By participating in a match, the User gives explicit consent to the inclusion of their image, audio, name, username, partner/team information, scores and performance data in the broadcast. The User understands that such broadcasts may remain accessible live, recorded, replayable and indefinitely.
The User irrevocably assents to the Company’s use of such image and recordings under a non-exclusive, worldwide, perpetual, royalty-free, transferable and sub-licensable license for the purposes of providing the service, archiving, promotion, marketing, social media and platform content.
The User agrees, declares and undertakes that they will not claim any fee, royalty, consideration or compensation from the Company in return for such use.
The User agrees not to raise any claim, objection, complaint or lawsuit against the Company, its business partners, broadcasting platforms or other participants on grounds of personality rights, privacy, image/voice rights or the like arising from the broadcast image and recordings, and waives such rights in advance. This waiver is valid without prejudice to mandatory rules of law and the legally non-waivable rights granted to the data subject by the KVKK.
If the User does not wish to be broadcast, they have the right not to participate in the relevant match or to notify the Company in writing at [email protected] before recording/broadcast. Such notice is effective only for the period after its date and to the extent technically possible; it has no retroactive effect on content already broadcast live.
The User understands that their words, conduct and image during a match may appear in the broadcast; and accepts personal responsibility for any insult, profanity, harassment or conduct infringing third-party rights.
As only individuals aged 18 or older may register, all Users appearing in broadcasts are deemed to be over 18.

8. Intellectual Property

All intellectual and industrial property rights in the Platform’s software, design, trademarks, logos, content and live streams belong to the Company or its licensors. The User may not copy, reproduce, distribute or commercially exploit this content without the Company’s written permission.

9. Prohibited Conduct

Creating fake accounts or impersonating others.
Accessing the Platform or scraping data via automated tools/bots.
Distributing malware or overloading the system.
Sharing unlawful, obscene, hateful content or content infringing third-party rights.
Fraudulently manipulating the score/rating system.

10. Limitation of Liability

The Company is not liable for indirect, incidental, special or consequential damages, data loss, loss of profit, or the acts of third parties arising from use of the Service. The risk and responsibility arising from matches, disputes and physical activity between Users belong to the Users. The User accepts that they participate in sports activities of their own free will and at their own risk.

11. Fees

The Service is currently free of charge. The Company reserves the right to make certain features paid in the future; in that case, paid features will be clearly indicated and the User’s consent obtained.

12. Protection of Personal Data

Detailed information on the processing of your personal data is set out in the Data Processing Notice, Privacy Policy and Data Protection (KVKK) Policy. These documents form an integral part of the Agreement.

13. Termination and Suspension

The User may terminate the Agreement at any time by closing their account. In case of breach, the Company may suspend the User’s access or close the account without prior notice.

14. Changes

The Company reserves the right to update the Agreement. The current version takes effect once published on the Platform. The User’s continued use of the Platform after an update means acceptance of the changes.

15. Force Majeure

In events beyond the parties’ control — such as natural disasters, fire, epidemics, cyber-attacks, infrastructure and communication outages, and decisions of public authorities — the affected party cannot be held liable for failure to perform its obligations.

16. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye. The İstanbul (Anadolu) Courts and Enforcement Offices have jurisdiction over disputes arising from the Agreement. For Users who qualify as consumers, the jurisdiction rules of the applicable consumer legislation are reserved.

17. Effectiveness and Acceptance

By registering for or using the Platform, the User declares that they have read, understood and accepted this Agreement in its entirety — and, in particular, expressly accept the provisions on live streaming, image and audio recording set out in Article 7. The Agreement takes effect upon acceptance.
